Even as Finance Minister P. Chidambaram said that a final decision on expiry of tax benefits to export-oriented units (EoUs) and Software Technology Parks of India (STPls) had not been taken yet, government sources indicated that an extension of the concessions was unlikely.
 
Finance Minister, P. Chidambaram said "We have up to 31-3-2009, to take, a view on that."
STPIs and EoUs enjoy direct-tax exemptions under section 10A and 10B of the Income Tax Act, 1961, which are set to expire on 31-3-2009. There are more than 8,000 STPI-registered units and 2,300 EoU units spared across the country.
Finance ministry officials added that companies should not have put up units in STPI and EoUs, knowing that the provisions were set to end by 31-3-2009. "Small players knew that the tax exemption was ending. If they knew that, why did they set up units," an official said, adding that while there was enough time till March 2009 to take a final decision, "how long can one keep feeding milk to children".
A high-power committee, headed by National Manufacturing Competitiveness Council (NMCC) Chairman V. Krishnamurthy, had recommended to the finance ministry to extend the expiry of tax benefits for EoUs by another year. Moreover, a finance ministry sponsored study, conducted by economic think-tank Indian Council of Research in International Economic Relations (ICRIER) has also recommended extension of the tax sops for STPIs and EoUs.
In Budget 2008-09, fiscal benefits to EoUs were further tightened by making sale of goods to domestic tariff area more costlier. This was done by increasing basic Customs duty payable by EoUs for sale of goods to DTAs from 25 per cent to 50 per cent. This would further squeeze profits of EoUs, on which Minimum Alternative Tax (MAT) was imposed.
 
To promote outsourcing of research, a weighted deduction of 125% on any payment made to companies engaged research and development is proposed.
 
Deduction in respect of sum paid to a company for scientific research
 
The Finance Bill, 2008 proposes to introduce a new clause (iia) in sub-section (1) of section 35. The proposed section 35(1)(iia) seeks to provide tax benefits in respect of any sum paid to a company carrying on scientific research. This benefit would be allowable from the assessment year 2009-10.
 
(i) Benefit under section 35(1)(iia)-To whom available
Benefit under section 35(1) (iia) would be available only to a person carrying on business or profession. Therefore, any individual/AOP/HUF/BOI (other assessees would also be so eligible but we have referred to these entities because this article is focused on personal income-tax assessee) would be eligible for benefit under section 35(1)(iia) if they carry on any business or profession.
 
(ii) Benefit in respect of which amount
Tax benefit under section 35(1)(iia) would be available in respect of any amount paid to a company to be used by the company for scientific research.
 
(iii) Amount of deduction
Deduction under section 35(`1)(iia) would be allowed in an amount equal to 1.25 times of the sum paid to a company to be used by it for scientific research.
 
(iv) Condition to be fulfilled by company
 
  • The company to which payment can be made
  • shall be registered in India,
  • shall have as its main object the scientific research and development,
  • shall be, for a purposes of section 35(1)(iia), for the time being approved by the prescribed authority in the prescribed manner, and
  • shall fulfil such other conditions as may be prescribed.
